This paper focuses on the New South Wales Department of Community Services (DoCS) alternative dispute resolution (ADR) model. In broad terms, this document incorporates material or information from two chief sources: the DoCS discussion paper on ADR entitled “Alternative Dispute Resolution – A DoCS Discussion Paperâ€?; and current DoCS ADR policy and procedure. The discussion paper grew out of a DoCS initiative to understand and implement the Children and Young Persons (Care and Protection) Act 1998. This led to the development of the DoCS ADR model. This particular document presents the legislative framework, a summary of the DoCS ADR model, ADR principles, issues and challenges relating to ADR practice, and several relevant appendices.
