The first section of the article lays the groundwork for my analysis and provides a brief account of the theoretical and policy debates regarding restitution policies in general in the context of post-communist democratization. I then provide an overview of these issues in postcommunist Romania. I discuss issues related to legal and political controversies as well as problematic aspects of the implementation of Law 221/2009 extensively on the basis of primary documents. A shorter section regarding problems of legal redress concerning former members of the communist apparatus involved in the pre-1989 repression provides further insights into the topic of reconciliation and restitution. In conclusion, I address the current status of restorative justice measures in Romania as well as more general lessons that can be learned from this case study in the field of transitional justice.
