In this paper we will discuss the reality of Australia's criminal justice system behind the facade of law and order, as a reminder of the young lives we cannot see. We will also discuss positive measures by governments both internationally and domestically as benchmarks, and further necessary developments such as the national minimum standards legislation recommended in the report of the National Inquiry into the Separation of Aboriginal and Torres Strait Islander Children from their Families to prevent further breaches like those of the Northern Territory Government.
