In this paper Frehsee surveys restitution and mediation in the German criminal law. He looks at the development and application of restitution and mediation in the German criminal justice system, the perspectives of criminal justice professionals and victims on restitution and mediation, and the frequency and types of cases dealt with by restitution and mediation. On the whole, according to Frehsee, restitutive crime settlement is a marginal phenomenon in the German system. This leads to discussion of conceptual and practical reasons for this situation in German criminal justice.
