David Lerman asserts that the criminal justice system has the wrong focus. It aims primarily to incarcerate people who have committed offenses. This focus neglects major consequences of crime – the destruction of trust between people, and the resulting diminishment or tearing of the social fabric. The criminal justice system’s emphasis on incarceration does little to repair those damages. Hence, Daubney advocates restorative justice to refocus on the needs of victims and on repairing communities instead of simply jailing individuals.
