This is part of a response filed by the defense attorney in an appeal process on behalf of a defendant. The defendant had been sentenced by the trial judge to alternative measures on the recommendation of a sentencing circle in which the defendant participated following his offense and conviction. (The Crown – Canada – had appealed and argued against the validity of the sentencing circle and the sentence itself.) This part of the response considers the place and value of sentencing and healing circles for dealing with wrongdoing in Aboriginal culture.
