Hamilton describes the current criminal justice system as a “boxâ€? characterized by retribution. It has serious flaws. In response to the flaws of this “boxâ€? or system, Hamilton proposes restorative justice. To develop his argument, he contrasts the state and the community. This leads to discussion of community conferencing, community circles, and the significance of dialogue. Then Hamilton examines restorative justice – its definition, purpose, principles and assumptions, and objectives. He also acknowledges various issues and limitations connected with restorative justice. Other significant topics in his paper include forgiveness and rehabilitation.
