The first section of the article lays the groundwork for
my analysis and provides a brief account of the theoretical
and policy debates regarding restitution policies in
general in the context of post-communist democratization.
I then provide an overview of these issues in postcommunist
Romania. I discuss issues related to legal and
political controversies as well as problematic aspects of
the implementation of Law 221/2009 extensively on the
basis of primary documents. A shorter section regarding
problems of legal redress concerning former members
of the communist apparatus involved in the pre-1989 repression
provides further insights into the topic of reconciliation
and restitution. In conclusion, I address the
current status of restorative justice measures in Romania
as well as more general lessons that can be learned from
this case study in the field of transitional justice. (excerpt)
