“This chapter examines contemporary neoliberal US administrative procedure in order to better understand the logic and practice of neoliberal administrative accountability. Specifically, what are the sociopolitical and juridical features of the new market-based accountability? To what extent is this particular logic of administrative accountability transforming welfare-state mechanisms of accountability by infusing, if not pre-empting, the rulemaking process with institutionalized “consent agreements” negotiated by “stakeholders”?
