A reparation and mediation scheme has been available in Scotland for several years. The only access at present is through the fiscals (the public prosecutors) and the scheme is aimed at diverting cases from formal court proceedings. An evaluative study of the project showed that actual and potential value of this approach to crime for victims, accused and the Scottish Criminal Justice System. At the same time, problems emerged that did not relate to the practice of reparation and mediation but to only being available as a formal diversion scheme.
