Settlements out of court: A comparative study of European criminal justice systems

The South African Law Commission has undertaken a project in the “Simplification of Criminal Procedure.â€? As part of this project, it instigated an investigation into out-of-court settlements, where the prosecutor could discontinue prosecution in certain cases and pursue other means to resolve a crime or conflict. In this report for the Commission, Hans Jorg Albrecht , professor at an institute for foreign and criminal law in Germany, studies current developments in out-of-court settlements in Europe. He identifies basic trends, the process of developing and implementing settlements, and community-based responses and relief for victims through settlements. Also, he examines legislative frameworks and procedural elements in out-of-court settlements in European countries.
