This paper provides information on the new Austrian Juvenile Justice Act, the practice of out-of-court offense compensation embodied within this law, and the problems that have evolved from this practice. A short review of the law-making process in Austria’s Juvenile Justice system is presented, and the specific character of the probation service is described. Some recent data compiled from the state prosecutorÃs offices is discussed. Lastly, information is given on research plans and on first results from a workgroup in Vienna that has undertaken the task of designing a professional profile of the mediator within the Austrian ATA (AuØergerichtlicher Tatausgleich).
